German Court Approves Limited Medical Marijuana Cultivation

A German court ruled earlier this month that seriously ill patients can grow their own medical marijuana, but the ruling won’t apply to all medical marijuana patients. The Federal Administrative Court in Munster held that people for whom no other effective remedies are available or affordable can apply to the Federal Institute for Drugs and Medical Devices (BfArM) for a license to grow their medicine if done under a doctor’s supervision.

USA: Will The President Go After Legal Weed In Colorado And Washington? | Marijuana.com



It has been nearly seven weeks since voters in Colorado and Washington made history, enacting at the ballot box unprecedented measures legalizing the adult possession on cannabis. Yet during this time, federal officials have largely remained silent.

One week ago, US Attorney General Eric Holder cryptically told Bloomberg News that the administration will formally announce its intentions “relatively soon,” but added no further details. Most recently, on Friday, President Obama told ABC News’ Barbara Walters: “It would not make sense for us to see a top priority as going after recreational users in states that have determined that it’s legal. … We’ve got bigger fish to fry.” Of course, federal officials do not target minor marijuana offenders now — so the President’s statement provides little clarity as to what actions the Administration may take going forward as Colorado and Washington begin implementing broader regulatory reforms, including measures to license proprietors to commercially produce and sell cannabis to adults.

Today, in Alternet.org, I speculate as to what actions the Administration may take — and what actions they may not take — in the coming weeks as state lawmakers work toward the full implementation of Colorado and Washington’s newly enacted marijuana laws. An excerpt from this commentary appears below.

With public opinion firmly behind the will of the voters, is it realistic to think that the Obama Justice Department will take action to try and nullify Colorado and Washington’s legalization laws? It’s possible, but it may not be as likely as some think.

For starters, states are not mandated under the US Controlled Substances Act to criminalize marijuana or to arrest and prosecute adult weed consumers and the federal government cannot compel prosecutors in Colorado or Washington to do so. The Justice Department and the US Drug Enforcement Administration could, theoretically, choose to selectively prosecute those individuals in Colorado and Washington who possess or grow quantities of plant that are compliant with state law. But such a scenario is hardly plausible. The federal government lacks the manpower and the public support – and therefore the political will – to engage in such behavior and this reality is unlikely to change any time soon. As acknowledged by former congressman and ex-DEA director Asa Hutchinson at a recent CATO Institute forum on the subject, the federal government never has prosecuted people for possessing an ounce of marijuana and it is not about to start doing so now.

 By contrast, the Obama administration may attempt to actively prohibit states from allowing for the above-ground, licensed production and sale of weed by authorized proprietors. Justice Department officials could theoretically do so by either bringing a legal challenge against the states, by threatening local officials, or by proposing to withhold federal funding. But none of these actions are assured. Here’s why.

To date, the Obama administration has done little to interfere with the state-approved production and licensed distribution of medical marijuana in those states that explicitly license and regulate this activity — specifically in Arizona, Colorado, Maine, New Jersey, and New Mexico. (In recent days, some of the first state-approved dispensaries opened for business in Arizona and New Jersey. In coming months, licensed dispensaries are also anticipated to open their doors to the public in Vermont as well as the District of Columbia. **AUTHOR’S NOTE: By contrast, the Justice Department has taken actions to aggressively close operations in California, Oregon, Montana, and Washington — though none of these states explicitly license dispensaries.**) In Colorado – where the state has licensed several hundreds of cannabis dispensaries and oversees “seed to sale” regulations governing the plant’s production and distribution – federal officials have yet to either file suit or threaten any of the state regulators who oversee the program. In response to a lawsuit filed in 2011 by Arizona Gov. Jan Brewer, who sought to invalidate the state’s 2010 medical cannabis law, lawyers for the federal government affirmed that the administration had never engaged in such strong-arm tactics and did not intend to.

The federal judge in the case agreed. She rejected Gov. Brewer’s legal arguments that the operation of state-approved medical marijuana dispensaries was preempted by federal law or put state employees at risk for federal prosecution, determining “[T]he Complaint does not detail any history of prosecution of state employees for participation in state medical marijuana licensing schemes [and] fails to establish that Plaintiffs are subject to a genuine threat of imminent prosecution and consequently, the Complaint does not meet the constitutional requirements for ripeness.”

A Maricopa County (AZ) Superior Court ruling from earlier this month further affirms that states possess the legal authority to regulate the legal distribution of cannabis, at least in some specific instances, without running afoul of federal anti-drug laws. In the case before the Court, White Mountain Health Center, Inc. v. Maricopa County, Judge Michael Gordon determined that the federal Controlled Substances Act did not preempt Arizona’s efforts to authorize “the local cultivation, sale, and use, of medical marijuana.” Writing for the Court, Judge Gordon declared that nothing in Arizona’s law circumvents federal law since Justice Department officials could still continue to locally enforce the Controlled Substances Act. In fact, Judge Gordon suggested that the new law “affirmatively provides a roadmap for federal enforcement of the CSA, if they so wished to” since the statute requires patients and proprietors to register their activities with the state. He concluded: “The Court rejects … arguments that the [law] violates public policy simply because marijuana use and possession violate federal law. Eighteen states and the District of Columbia have passed legislation permitting the use of marijuana in whole or in part. The Court will not rule that Arizona, having sided with the ever-growing minority of States, and having limited it to medical use, has violated public policy.”

Some legal experts, including law professor Robert Mikos of Vanderbilt University Law School, suggest an additional legal theory as to why Colorado and Washington’s proposed regulatory schemes may not be subject to federal preemption. Speaking at a recent CATO Institute sponsored forum, Mikos suggested that the newly enacted state legalization laws do not violate the spirit or the intent of the Controlled Substances Act because the federal law exists for the expressed purpose of limiting the consumption of certain substances by the public, particularly young people. One can argue that the proposed statewide regulatory schemes in Colorado and Washington – which impose age restrictions for buyers and limit sellers to those authorized by the state – are intended to serve a similar purpose. Further, the proposed state programs, “do not stop federal authorities from sanctioning registrants.” Notably, Superior Court Judge Gordon specifically highlighted these arguments in his decision to uphold Arizona’s law and to reject claims that it positively conflicted with federal law.

“No one can argue that the federal government’s ability to enforce the CSA is impaired to the slightest degree [by Arizona’s medical marijuana law],” he opined. “Instead of frustrating the CSA’s purpose, it is sensible to argue that the [law] furthers the CSA’s objectives in combating drug abuse and the illegitimate trafficking of controlled substances.”

Everyone knows Snoop Dogg loves weed, so he fielded a bunch of marijuana-related questions during a Reddit “Ask Me Anything” session.

He said the longest he’s gone without smoking weed was 164 days, he’s for the taxation of marijuana as long as it’s legalized… and he gave the exact number of blunts he smokes a week.

When asked: On average, how much do you smoke in a week?

His reply was 81 blunts a day x 7, equaling 567 blunts a week! Wow!

Now that states have started legalizing recreational marijuana, will the president continue the government’s war on weed?

When voters in Colorado and Washington state legalized recreational marijuana in November, they thought they were declaring a cease-fire in the War on Drugs. Thanks to ballot initiatives that passed by wide margins on Election Day, adults 21 or older in both states can now legally possess up to an ounce of marijuana. The new laws also compel Colorado and Washington to license private businesses to cultivate and sell pot, and to levy taxes on the proceeds. Together, the two states expect to reap some $600 million annually in marijuana revenues for schools, roads and other projects. The only losers, in fact, will be the Mexican drug lords, who currently supply as much as two-thirds of America's pot.

Drug reformers can scarcely believe their landslide victories at the polls. "People expected this day would come, but most didn't expect it to come this soon," says Norm Stamper, a former Seattle police chief who campaigned for legalization. "This is the beginning of the end of prohibition."

But the war over pot may be far from over. Legalization has set Colorado and Washington on a collision course with the Obama administration, which has shown no sign of backing down on its full-scale assault on pot growers and distributors. Although the president pledged to go easy on medical marijuana – now legal in 18 states – he has actually launched more raids on state-sanctioned pot dispensaries than George W. Bush, and has threatened to prosecute state officials who oversee medical marijuana as if they were drug lords. And while the administration has yet to issue a definitive response to the two new laws, the Justice Department was quick to signal that it has no plans to heed the will of voters. "Enforcement of the Controlled Substances Act," the department announced in November, "remains unchanged."

A bipartisan group of legislators from around the country led by Rep. Diana DeGette (D-Colorado) on Tuesday introduced a bill in Congress that would clarify that Colorado and Washington may fully implement the new marijuana laws approved by voters on November 6.

The bill, known as the "Respect States' and Citizens' Rights Act," would add a provision to the federal Controlled Substances Act expressly stating that state marijuana laws shall not be preempted by federal law.

HONOLULU, HI – As more Americans demand legalization of cannabis, thousands of prisoners are still locked up on non-violent marijuana charges, including Reverend Roger Christie, incarcerated in Hawaii.

Since July 8, 2010 Rev. Christie has been behind bars without bail awaiting trial on charges of marijuana possession and trafficking, despite being a Christian minister with a state sanctioned license as a ”Cannabis Sacrament Minister.” Rev. Christie’s case is unique because his use of cannabis was for religious purposes, which he believes should be protected under the First Amendment and the Religious Freedom Restoration Act.

Because cannabis has an ancient history of ritual usage in many religions and cultures including Christianity, Christie has decided not to accept a plea agreement from prosecutors, and is challenging the case in court. His perspective is couched in a religious context of medicinal cannabis as a tool in healing the sick which to deny anyone is counter to morality. Rev. Christie also connects cannabis sacrament to the ancient anointings and burnt offerings referenced in the bible.

This Christmas is Rev. Christie’s third incarceration at the Honolulu Federal Detention Center. Despite seven attempts at bail, U.S. District Court Judge Leslie Kobayashi has denied Christie’s request to be released to his home in Hilo or to a halfway house in Kalihi.

Tommy Otake, Rev. Christie’s attorney, said his client was at first disappointed by the ruling, but then decided to remain positive and take the most recent bail denial as a “blessing.” Rev. Christie is committed to the Christian faith and to religious freedom for all. He is continuing to minister while in prison and is using his time as an opportunity to help other inmates.

Otake says, “Rev. Christie is a peaceful man who should be granted release to prepare for trial. Reverend Christie looks forward to the day he will regain his religious freedom through due process.”

Rev. Christie is currently awaiting trial scheduled for March 12, 2013.

Like alcohol prohibition before it, the criminalization of pot is a failed federal policy that delegates the burden of enforcement to the state and local police. How did America’s ‘Nobel Experiment’ with alcohol prohibition come to an end?

Voters in Colorado and Washington made history on Election Day. For the first time ever, a majority of voters decided at the ballot box to abolish cannabis prohibition.

In Colorado, 55 percent of voters – four percent more than favored President Barack Obama – decided in favor of Amendment 64, a constitutional amendment that allows for the legal possession of up to one ounce of marijuana and/or the cultivation of up to six cannabis plants in private by those persons age 21 and over. In Washington, 55 percent of voters similarly decided in favor of Initiative 502, which removes criminal penalties regarding the adult possession of up to one ounce of cannabis for personal use (as well as the possession of up to 16 ounces of marijuana-infused product in solid form, and 72 ounces of marijuana-infused product in liquid form.) Washington’s new law takes effect on December 6. Colorado’s measure becomes law in early January. (Additional provisions seeking to enact state-licensed regulations governing the potential sale and taxation of cannabis do not begin taking effect until early 2014.)

Raymond Yans – unfortunately, is the man in charge of the United Nations “War on drugs” (why are they involved…oh yea “War”). Apparently Mr. Yans seems a little perturbed that his job might potentially be in jeopardy. As such he has told the US federal government and anyone else that might listen, the feds should stand up and fight against Colorado and Washington’s effort, to do away with the federal prohibition against marijuana and those who may possess small amounts of pot for adult consumption.

Mr Yans job fearing rhetoric – and out of date contention, that the common sense approach to marijuana regulation put forth by Washington and Colorado’s voter’s somehow sends ”a wrong message to the rest of the nation and it sends a wrong message abroad.” Is absurd at best, and a boldfaced lie at worst.

Obviously Mr. Yans’ proclamation that Washington and Oregon should return to a failed and moronic policy was greeted with varying degrees of anger, frustration and straight up hostility…

Arizona’s health services department director just returned from a field inspection for a dispensary applicant in Glendale AZ. The AHSD reports that they discovered no major deficiencies in their operational structure, as such they awarded the marijuana dispensary an “approval to operate” notification late yesterday afternoon, November 15, 2012. This Glendale Arizona approval for a marijuana dispensary represents a quantum leap forward for Arizona as this represents the first license issued in the State

New Jersey: ”When the now disgraced Gov. Jon Corzine signed the New Jersey Compassionate Use Medical Marijuana Act into law on January 18, 2010. As initially passed, the law was scheduled to take effect in July 2010. However, lawmakers in June amended the legislation at the behest of Republican Gov. Chris Christie to delay the enactment of the law until October 1, 2010. The law mandates the state to promulgate rules governing the distribution of medical cannabis to state-authorized patients. These rules shall address the creation of up to six state-licensed “alternative treatment centers.” Patients diagnosed with the following illnesses are afforded legal protection under this act: cancer, glaucoma, seizure and/or spasticity disorders (including epilepsy), Lou Gehrig’s disease, multiple sclerosis, muscular dystrophy, HIV/AIDS, inflammatory bowel disease (including Crohn’s disease), any terminal illness if a doctor has determined the patient will die within a year. Other conditions are subject to approval by the state Department of Health. Patients authorized to use marijuana under this act will not be permitted to cultivate their own cannabis, and are limited to the possession of two ounces of marijuana per month.”

Maine: At this pivotal time in America's history, when lawmakers motivated by lobbyists and money in several states are hunting for new ways to restrict or suspend their voter approved medical marijuana programs, Maine’s pro-constituent politicians are expanding its patient’s protections and access under the law.

Massachusetts: Massachusetts helps America turn 18. Okay that was just for headline sake – but they were the 18th state in the US to allow marijuana for medicinal purposes. With an impressive 63% approval, Massachusetts became the 18th state to permit their doctors to recommend marijuana for medicinal use. Within the Massachusetts statute patients will be allowed to possess up to a 60 day supply of pot for their medicinal purposes. Good to hear.

New Hampshire: Twice Medical marijuana bills have sent up to the New Hampshire governor for his signature, first in 2009 , and most recently in 2012, and both times they were sent back vetoed then eventually shelved. With the pot hating Gov. of New Hampshire John Lynch getting ready to hang up his hat and call it a day, his political replacement is a long time medical marijuana supporter Maggie Hassan. Apparently she stands ready to jump at the opportunity to finally green light this bill and puff, puff, pass it into law with a governor’s “John Hancock” in 2013.

In a logical attempt to stomp out organized criminal activity in the country of Uruguay, they have sought to do away with one of their more lucrative incomes, the sales of illegal marijuana. Instead, they have stepped into the role that was once occupied by the street level drug dealer – having legalized the public sales of up to 20 joints of Uruguay’s best smoke every month ( which for the sake of political correctness they are calling ‘cigarettes’).

As it now stands Uruguay’s citizens will be able to stroll down to their local state run pot market and purchase up to 40 grams… or approximately 1.4 ounces of chronic bud per month. Depending on how thick you roll your joints, thats approximately 20 normal sized dubbies worth (not bad). The kicker here is that the sale will be regulated by the state with the state legal weed being sold at a yet to be determined market price.

As the potential full-scale legalization effort for the use of recreational marijuana in the U.S. is now two states deep, and the great states of Colorado and Washington voiced their opposition to marijuana prohibition. Mexico is feeling backed into a corner, and being forced to “reevaluate its costly battle to make a dent in the large quantity of marijuana smuggling that currently makes its way across the border,” noted Luis Videgaray the primary go to guy for Mexico’s transition team for their new president-elect Enrique Pena Nieto’s.

“Obviously we can’t handle a product that is illegal in Mexico; why we should try and stop its transfer to the United States? When in the U.S., at least in Colorado and Washington, it has a different status,” Videgaray went on to reflect. “I believe this compels us to re-think the relationship, particularly in regards to security … For us this is an unfortunate and unforeseen element.” source


Mr. Videgaray just barely pulled up short of making a full-scale threat, of outright walking away from their Mexican enforcement efforts, keeping Mexican grown pot from crossing the border and into United States market (yuck). Unfortunately for both sides – these ill-timed comments came less than a month before President-elect Pena Nieto is to make his long anticipated journey to the White House. Just days before taking office, Mexico’s President-elect appeared to like the new political position they find themselves in, as they are now the ones applying pressure on the Obama administration to strictly enforce their federal law, which continues to prohibit the recreational use of pot.

In the United States, as we all know, a relatively small minority of Americans have managed to seize control of the vast wealth that is America, while the remainder of us poor, soulless fools struggle to survive in a vicious, dog eat dog world. It is with this knowledge that the underground marijuana economy, whether for recreational purposes or medical have continued to be one of the few ways for those underprivileged, underfunded have-nots – that have been left behind economically – can create an income, and give ourselves a fighting chance at supporting our families.

As marijuana advocates toil in the political killing fields of American politics, working tirelessly to try and legalize this demonized plant, thereby providing regulation to this otherwise shady aspect of America’s underground commerce; and driving the final nail in the coffin of marijuana prohibition, once and for all putting an end to the arrests and imprisonment of otherwise innocent law-abiding citizens simply for choosing to ‘fire up’ one of God’s curative plants. Johnson is currently under investigation by his own Sheriff’s Department, this after a small army of federal agents swarmed down on Capt. Johnson’s property discovering more than 500 fully mature marijuana plants. The property in question is apparently owned by Capt. Johnson’s elderly father – Johnny Johnson – it was there on October 11, that the DEA, IRS and FBI all descended, with betrayal on their mind and malice in their heart. This recent discovery of Mendocino's own Sheriff’s Department involved in the cultivation of California’s most valuable weed was just one of many investigations involving Mendocino County officials, marijuana cultivation and the extended members in their families.

Holy hell - Mr. Sandusky is looking at a life sentence if the Fed’s have their way and he is convicted on all counts.

The owner of an Inland Empire chain of marijuana stores is due to face trial next week in Los Angeles on charges of violating federal pot laws.

Aaron Sandusky, 42, of Rancho Cucamonga -- founder and owner of G3 Holistic stores in Upland, Colton and Moreno Valley -- is charged with six felony counts, including conspiracy to manufacture and possess with intent to distribute marijuana and possession with intent to distribute the drug, according to the U.S. Attorney's Office.

The trial, which is scheduled to begin Tuesday in Los Angeles before U.S. District Judge Percy Anderson, is expected to be watched closely by those on both sides of the medical marijuana issue.

A federal indictment alleges that the now-closed G3 Holistic chain was using California's Prop. 215 and other state laws regulating legal medical marijuana sales to cover for an illegal for-profit marijuana growing and sales operation that took in more than $3.3 million during an eight-month period last year. Part-time right wing douche bag, and full-time political hack, Bill O'Reilly exposed his ignorance… yet again last Thursday night. Mr. O'Reilly took the marijuana policy projects "top 50 most influential marijuana users" list and began to use it as the basis of his slam against the organization.

7. Comedian: John Stewart

Missing the point completely, that responsible marijuana use is anything but harmful to society, as is evident by the contributions (with the exception of Newt Gingrich) that each of these people have made to society.Despite the fact that they were also stoners.

As is true with alcohol… There are those that use pot at the end of the day to wash away the anxiety and stress of daily life. Then there are those who choose to abuse it, the same way they do any other substance that is limited by only free will and good decisions.

Instead Mr. O'Reilly took the marijuana policy Project to task, claiming that their message was “pot for everyone.” As a means of perverting and twisting the very logical argument that responsible drug use does not make a person a criminal; and that jailing peaceful, productive people over how they choose to relax in the privacy of their own home , is absolute insanity.

Since Jan Brewer and her attorney general were not able to stop the state’s voters from approving Arizona's medical marijuana law. They have sent the Arizona Department of Health services main man, rules administrator, Tom Salow rifling through the backgrounds of Arizona's caregivers, searching for that needle in a haystack. A violent crime history, that went undisclosed on a document, or perhaps a past, which involved some type of illicit drug, or violent crime history.

While voters passed the Arizona medical marijuana law back in 2010, it was designed to allow people with certain incapacitating ailments, including HIV AIDS waste syndrome, cancer, muscle spasms and most notablychronic pain. While they've had over two years to try and put together a cohesive system, that operated in a timely manner. The ADHS director stated that the agency is bogged down in a backlog of anxious patients seeking the states authorization to enjoy the medicinal benefits of a God given plant.

I'm pretty sure everyone in California, at least those with in the medical marijuana community feel that the four state attorney generals are in the pocket of big pharmaceutical companies. Once we get past the November election, it is the general consensus within the medical marijuana community that big pharmaceutical companies will step in and take over with the help of the federal government.

Since the American public sentiment is over 70% in favor of medical marijuana, and the federal government hates the marijuana plant, yet holds a patent to all of its cannabinoids worth hundreds of billions of dollars. If I were a betting man... I'd take the action on the next president, regardless of who it is rescheduling marijuana, and leasing their patents to American pharmaceutical companies and raking in profits off the plant they said had no medicinal value.


With that said and done the prohibition of this "plant" will come back with a vengeance. In the meantime both the Long Beach and Los Angeles city Council are fighting the tide of public sentiment, which is a losing battle.

The city Council had grown tired of the cat and mouse game, and passed in a 14 to 0 vote the ban that would do away with medical marijuana in the city of Los Angeles… Or at least so they thought.
